TERMS AND CONDITIONS
NO PURCHASE OR PAYMENT OR DONATION OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST. A PURCHASE OR PAYMENT OR DONATION WILL NOT INCREASE YOUR CHANCES OF WINNING.
Independent Women’s Voice (the "Sponsor") is sponsoring a contest entitled “ObamaCare Anniversary Video Contest” (the “Contest”). The Contest is subject to all federal, state, and local laws, regulations, and ordinances. The Contest begins at 12:00 AM Eastern Standard Time (“EST”) on February 11, 2011 and ends at 12:00 AM EST on March 19, 2011 (the "Video Submission Period"). It is void outside the United States and where prohibited by law.
ELIGIBILITY: The Contest is open only to entrants who are legal residents of the 50 United States (including the District of Columbia) who are the age of majority in their state of residence at the time of entry. Employees, officers and directors of Sponsor, and those working on behalf of Sponsor including representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, Web-site providers, Web masters, and members of their immediate families (spouses, parents, siblings and children, regardless of where they live) and those living in the same household are not eligible to enter or win. Sponsor reserves the right to verify the eligibility of winners. Participation constitutes entrant's full and unconditional agreement to these Terms and Conditions and to Sponsor's decisions, which are final and binding in all matters related to the Contest.
THE CONTEST: Contest entrants are invited to submit videos of one minute or less that dramatize the problems with ObamaCare. The video can be clever, personal, funny or touching – however you can make the most compelling case. The winning video submission will receive a $5,000 cash prize. The second and third prizes are $2,500 and $1,000, respectively, and there will be a $500 cash prize for honorable mention. All winning videos will be featured on IWV's YouTube channel and at iwvoice.org.
CONTEST RULES: Entrants are asked to send videos that dramatize the problems with ObamaCare. The Contest winners will be determined by whichever video has the most "My choice for winner" comments from unique YouTube accounts at 12:01 a.m. EST on March 23, 2011. The winner will be notified by email and telephone, and announced on iwvoice.org at 12 p.m. March 23, 2011..
HOW TO ENTER: Entrants must submit their video of one minute or less, and no bigger than 2 GB, along with their full name, phone number, state of residence and the words "I agree to the IWV Video Contest Rules" in the body of the email to [email protected] with "IWV Video Contest Entry" as the subject. Videos should be in MP4, MPEG, MPG, WMV, AVI, or MOV format.
Each video must be the original work of one individual or collaborative team. Entries that do not agree to the terms and conditions will not be judged. Entrants must provide all required information in their email submission to be eligible to enter. Entries must be submitted by the registered entrant. All entries become the property of Sponsor when submitted and will not be returned to entrant. Normal Internet, phone and usage charges imposed by your online or phone service may apply. Incomplete, illegible, corrupted, or untimely entries are void and will be disqualified. Sponsor is not responsible for lost, late, incomplete, damaged, stolen, misdirected, or illegible entries; lost, interrupted, or unavailable network, server, or other connections; or miscommunication, computer or software malfunctions, telephone transmission problems, technical failures, garbled transmissions, messages undelivered due to spam filters, damage to a user's computer equipment (software or hardware), or other errors or malfunctions of any kind whether, human, mechanical, electronic or otherwise. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. In the event of a dispute as to the identity of an entrant, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant. The authorized account holder is the natural person assigned an e-mail address by an Internet access provider, online service provider, Internet service provider, or other organization
(which may include an employer) responsible for assigning e-mail addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder. Entries specifying an invalid, non-working, or inactive e-mail address will be disqualified and ineligible to win.
1. ALL ENTRIES MUST BE YOUR OWN ORIGINAL WORK AND CANNOT CONTAIN ANY COPYRIGHTED OR PREVIOUSLY PUBLISHED MATERIALS.
2. All videos must not be longer than 1 minute in length.
3. Video size cannot exceed 2 GB.
4. Entrants are free to use any reasonable genre or form of content, including music, drama, humor, documentary, autobiography or animation.
5. Your video can advocate government action, such as increasing or decreasing the amount of funding for healthcare programs, but may not ask viewers to contact government officials in support of specific or proposed legislation.
6. Videos must be in English. Submissions must not contain offensive, sexually-oriented, or defamatory statements. Once submitted, an entry is final and may not be altered or edited further. Duplicate entries will disqualify all such entries.
SUBMISSION DEADLINE: All entries must be received by 12:00 AM EST, Saturday, March 19, 2011.
JUDGING: Contest winner will be determined by whichever video has the most "My choice for winner" comments from unique YouTube accounts at 12:01 a.m. EST on March 23, 2011.
WINNER SELECTION: Sponsor will upload video submissions to its YouTube Channel as it receives them, on a rolling basis. No video submissions will be uploaded that are received by Sponsor after the 12:00 a.m. EST, March 19, 2011 deadline. Contest winner will be determined by whichever video has the most "My choice for winner" comments from unique YouTube accounts at 12:01 a.m. EST on March 23, 2011. Because submissions will be uploaded on a rolling basis and viewers will have the opportunity to submit “My choice for winner” comments immediately for each video, Sponsor encourages participants to submit videos promptly.
PRIZES: The winning video submission will receive a $5,000 cash prize. The second and third prizes are $2,500 and $1,000, respectively, and there will be a $500 cash prize for honorable mention. All winning videos will be featured on IWV's YouTube channel and at iwvoice.org.
DISCLAIMERS: Entry into this Contest constitutes your acceptance of these Terms and Conditions. By entering a video in the Contest, the entrant agrees that Sponsor shall have the unrestricted royalty-free right to use the video for any purpose associated with the Contest, including publicizing and promoting the Contest. Entrants acknowledge that submissions will not be returned. By submitting a video, contestant represents that the video submitted with his/her entry is original to and that the entrant has all necessary rights in and to the video, including but not limited to (for videos) the consent of all individuals (or their parent/guardian if any such person is under the age of 18) who are included in their video and/or who are named therein, to enter the video in this Contest and for display online. Further, by submitting a video, you represent that you waive, all moral rights in and to the video. All Contest videos are subject to approval by (and may be rejected at the discretion of) Sponsor and must not contain any nudity, profanity or obscene subject matter nor use branded logos or trademarks, licensed music or licensed video content nor contain any anti-Sponsor references. All videos must be original work of the contestant and not infringe the rights of any third party. Entries not complying with these Contest rules will be disqualified.
NOTIFICATION OF WINNERS: Selected winners will be notified by email and telephone, and announced on iwvoices.org at 12 p.m. March 23, 2011. At least three (3) attempts over two (2) business days will be made to contact the winner. If the winner cannot be contacted by telephone or email on or before 12:00 PM EST on Wednesday, March 30, 2011, Sponsor has the right to disqualify that winner and to select, in its sole and absolute discretion, another entrant as a winner.
Before being declared a winner, the selected entrant must sign Sponsor's declaration and release form to (a) accept the designation as a winner and confirm compliance with these rules; (b) release, waive and forever discharge all right, in contract or tort, to damages against Sponsor or its affiliates for any loss or injury sustained as a result of being a winner and participating in the Contest; (c) consent to the use of his/her name, address, photograph or likeness for any publicity purpose connected with this Contest, without any further compensation, other than the prize offered; (d) granting an unrestricted, royalty-free license, including of copyright and trademark rights, in the video or written submission to Sponsor; and (e) delivering release documentation from the owner (or their parent/guardian if such person is under the age of majority) of any video or written entry (or any portion thereof) which is not owned by the selected entrant and/or from any person whose likeness appears in any video (or their parent/guardian if such person is under the age of majority). The signed declaration and release form may be sent by mail, fax, or scanned PDF via e-mail and must be received by Sponsor by Wednesday April 6, 2011. Failure to meet this deadline will disqualify the entrant and Sponsor may, in its sole and exclusive discretion, select another entry from remaining eligible entries in accordance with these rules or, alternatively, may elect not to award that prize.
POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT'S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.
ADMINISTRATION: The Contest is administered and operated by the Sponsor. The decisions of the Sponsor are final and binding in all matters as they relate to this Contest, including without limitation, eligibility, and/or disqualification of entries.
GENERAL CONDITIONS: Sponsor reserves the right to terminate or amend this Contest at any time without prior notice if it considers that any factor may potentially interfere with its proper conduct as contemplated by these Terms and Conditions. This Contest is subject to all applicable federal, state and municipal laws. Sponsor and its agents are not responsible for any problems or technical malfunction of any computer online systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any Web site, or any
combination thereof, including any injury or damage to an entrant's or any other person's computer, related to or resulting from downloading any materials in this promotion. Sponsor reserves the right, in its sole discretion, to cancel or suspend this Contest should a virus, bug, or other cause beyond the reasonable control of Sponsor or its agents corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any Web site or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
Sponsor's failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision.
RELEASE AND LIMITATIONS OF LIABILITY: By participating in this contest, entrants agree that sponsor, affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment and marketing, Web-site providers, Web masters and their respective officers, directors, employees, representatives, and agents (the "released entities"), will have no liability whatsoever for, and shall be held harmless by entrants against, any liability for any injuries, losses or damages of any kind to persons, including personal injury or death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse, or use of the prize, entry, or participation in this contest or in any contest-related activity, or any claims based on publicity rights, defamation or invasion of privacy, or merchandise delivery. The released entities are not responsible if any prize cannot be awarded due to acts of god, acts of war, natural disasters, weather, or terrorism. By participating in this contest, entrants agree that the released entities will not be responsible or liable for any injuries, damages, or losses of any kind, including direct, indirect, incidental, consequential, or punitive damages to persons, including death, or to property arising out of access to and use of sponsor's web sites or the downloading from and/or printing material downloaded from said sites.
Except where prohibited by law, participation in the contest constitutes winner's grant to sponsor (which grant will be confirmed in writing on request of sponsor), its parent, subsidiaries, affiliates, retailers, distributors, advertising and promotion agencies, suppliers, and those acting pursuant to its authority, the right and permission to print, publish, broadcast, and use, worldwide in any media now known or hereafter developed, including but not limited to the World Wide Web, at any time or times, each winner's name, portrait, picture, voice, likeness, opinions and biographical information (including but not limited to hometown and state) for advertising, trade, and promotional purposes (including the announcement of his or her name on television or radio broadcast) without additional consideration, compensation, permission, or notification. Entrants agree that sponsor shall own the entries, which will not be acknowledged or returned, and that sponsor and its designees shall have the perpetual, worldwide right to edit, publish, and use the entries in any way and in any media for trade, advertising, promotional, and/or other purposes as sponsor and/or its designees may determine without further consideration to entrants or any third party.
Without limiting the foregoing, everything regarding this contest, including the web site and all prizes, are provided "as is" without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Some jurisdictions may not allow the limitations or exclusions of liability for incidental or consequential damages or exclusion of implied warranties, so some of the above limitations or exclusions may not apply. Check local laws for any restrictions or limitations regarding these limitations or exclusions.
Sponsor makes no warranties or representations whatsoever regarding the tax treatment of the prizes awarded in this contest. Additionally, it makes no warranties or representations whatsoever regarding the tax implications for any entrant or prize winner.
DISPUTES: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of Columbia or the Superior Court of the District of Columbia; (2) any and all claims, judgment, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys' fees; (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the District of Columbia, without giving effect to any choice of law or conflict of laws rules (whether of the District of Columbia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the District of Columbia.
